This Privacy Policy explains how OverhaulWorks Group LLC, a Texas limited liability company (“OverhaulWorks,” “we,” “us,” or “our”), collects, uses, and shares information when you use our Services. By using the Services, you agree to this Policy.
1. Scope
This Policy applies to all websites, subdomains, applications, and services operated by OverhaulWorks (collectively, the “Services”), including our corporate and partner website at overhaulworks.com and all of our consumer vertical websites and subdomains — including, without limitation, our HVAC vertical and any current or future verticals such as plumbing, electrical, fleet, facilities, and others, whether existing now or launched later.
OverhaulWorks is a marketing, referral, and matching service that connects you with independent, third-party service professionals (“Service Professionals” or “Pros”) and, where you request it, with third-party financing providers (“Financing Partners”). Understanding that role helps explain why we collect and share the information described below.
2. Information We Collect
Information you provide
- Contact details: name, email address, phone number, and mailing or service address, including ZIP code.
- Service request details: the type of service you need, a description of your issue, property details, preferred timing, and similar information you submit.
- Financing-related information: if you request financing, limited information you provide to initiate a referral to a Financing Partner. Financing applications themselves are submitted to and processed by the Financing Partner under their own privacy practices.
- Communications: information in messages, calls, or forms you send us.
Information collected automatically
- Usage and device data: IP address, browser and device type, operating system, pages viewed, referring URLs, and date/time stamps.
- Approximate location derived from your IP address or the ZIP/address you provide, used to match you with local Pros. We do not collect precise geolocation.
- Cookies and similar technologies, including advertising and analytics pixels, as described in Section 5.
We do not collect or process “sensitive data” as defined by the Texas Data Privacy and Security Act (for example, precise geolocation, health, biometric, racial or ethnic, religious, or immigration-status data), and we do not sell sensitive or biometric personal data.
3. How We Use Your Information
- To match you with a suitable Service Professional in your area and facilitate scheduling.
- To refer you to a Financing Partner when you request financing.
- To contact you about your request by phone, text/SMS, and email (see Section 6).
- To operate, maintain, secure, and improve the Services and prevent fraud.
- To market our Services and measure the performance of our advertising.
- To comply with law and enforce our Terms of Use.
4. How We Share Your Information
Delivering our Services necessarily involves sharing your information. We share it as follows:
- With matched Service Professionals. When we match you, we share your contact details and service request with the Pro so they can contact you, schedule, and perform the work. Once shared, the Pro’s use of your information is governed by the Pro’s own practices.
- With Financing Partners. If you request financing, we share the information needed to introduce you to a Financing Partner, whose own privacy practices then apply.
- With service providers. Vendors that support our operations (for example, hosting, CRM, communications, and analytics providers) process information on our behalf under contract.
- With advertising and analytics partners. We share certain online identifiers and activity with partners such as Meta, Google, TikTok, and Reddit to measure and deliver advertising (see Section 5).
- In business transfers. In connection with a merger, financing, acquisition, or sale of assets.
- For legal reasons. To comply with law, respond to lawful requests, or protect our rights, users, or the public.
We do not sell your information for money. However, some sharing for advertising may be considered a “sale,” “targeted advertising,” or “sharing” under certain state laws; see Section 8 for how to opt out.
5. Cookies, Analytics, and Advertising Technologies
We and our partners use cookies, pixels, and similar technologies to run the Services, understand usage, and deliver and measure advertising. These include the Meta Pixel, Google Analytics and Google Ads tags, the TikTok Pixel, and the Reddit Pixel. These tools may collect online identifiers, device and browsing information, and activity on our Services, and may be used to show you ads on other platforms.
You can accept or reject non-essential cookies, and change your choice at any time, using the cookie settings control available on our website. You can also control cookies through your browser settings and opt out of certain advertising:
- Google Analytics opt-out: tools.google.com/dlpage/gaoptout, and ad personalization via your Google Ads Settings.
- Meta: your Facebook/Instagram ad preferences.
- TikTok: your TikTok ad settings.
- Reddit: your Reddit account settings under ad personalization.
- Industry opt-outs: optout.aboutads.info and optout.networkadvertising.org.
We recognize and honor the Global Privacy Control (GPC) and other recognized universal opt-out mechanisms as described in Sections 8 and 9.
6. Communications and Consent
By submitting your information (including a phone number), you consent to receive calls, text/SMS messages, and emails from OverhaulWorks, the Service Professionals we match you with, and our Financing Partners regarding your request, including through automated means. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out of texts; use the unsubscribe link to opt out of marketing emails. We may still send non-marketing messages related to your request.
7. Data Retention and Security
We keep your information for as long as needed to provide the Services and for legitimate business or legal purposes, after which we delete or de-identify it. We use reasonable administrative, technical, and physical safeguards to protect your information; however, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Your Privacy Rights
Texas residents
Under the Texas Data Privacy and Security Act (TDPSA), Texas residents have the right to: (a) confirm whether we process their personal data and access it; (b) correct inaccuracies; (c) delete personal data; (d) obtain a portable copy; and (e) opt out of the processing of personal data for targeted advertising, the sale of personal data, or profiling that produces legal or similarly significant effects. We will not discriminate against you for exercising these rights.
We use advertising cookies and pixels (including Meta, Google, TikTok, and Reddit) for targeted advertising. To opt out of targeted advertising and any sale or sharing, you may (a) use the cookie settings control on our website, or (b) enable a universal opt-out mechanism such as the Global Privacy Control (GPC) in your browser, which we recognize and honor. You may also use an authorized agent to submit an opt-out request where permitted.
To exercise any of these rights, contact us at privacy@overhaulworks.com. We will respond within 45 days and may extend once by an additional 45 days where reasonably necessary, in which case we will notify you of the extension and the reason within the initial 45-day period. If we decline your request, we will explain why and how you may appeal. To appeal, reply to our response or contact privacy@overhaulworks.com; we will inform you of our decision on the appeal within 60 days. If your appeal is denied, you may submit a complaint to the Texas Attorney General at texasattorneygeneral.gov.
Residents of other states
Residents of California and other states with privacy laws may have similar rights, including to know, access, correct, delete, and opt out of the sale or sharing of personal information for targeted advertising. To exercise any of these rights, contact us at privacy@overhaulworks.com. We will not discriminate against you for exercising your rights, and you may use an authorized agent where permitted.
9. Universal Opt-Out and Do Not Track
We recognize and honor the Global Privacy Control (GPC) and other recognized universal opt-out preference signals. When we detect a valid signal, we treat it as your request to opt out of targeted advertising and any sale or sharing of your personal data for the browser or device that sent it. Because there is no common industry standard for “Do Not Track” (DNT) browser signals, we do not separately respond to DNT signals, but a valid GPC signal is honored as described above.
10. Children’s Privacy
The Services are intended for adults. We do not knowingly collect personal information from anyone under 18. If we learn we have collected such information, we will delete it. If you believe a minor has provided us information, contact us at privacy@overhaulworks.com.
11. Third-Party Practices
This Policy covers only OverhaulWorks. Service Professionals, Financing Partners, and other third parties handle your information under their own privacy policies, which we do not control and are not responsible for.
12. Changes to This Policy
We may update this Policy from time to time. The updated version is effective when posted, as shown by the “Last updated” date. If we make material changes, we will take reasonable steps to notify you.
13. Governing Law
OverhaulWorks Group LLC is organized under the laws of the State of Texas, and this Policy is governed by Texas law, without regard to conflict-of-laws principles.
